key details
Rent cap · Detail
No statewide limit on rent increases in the Residential Landlord and Tenant Act; municipalities are barred from regulating private residential rent absent legislative approval.
Deposit cap · Detail
§ 89-8-21 regulates use and return of security deposits but sets no maximum amount.
Rent increase notice · Detail
No rent-increase notice rule; an increase in a month-to-month tenancy is a change of terms subject to the 30-day termination notice (7 days week-to-week).
City rules · Detail
Municipal home-rule powers exclude regulating, directly or indirectly, the amount of rent charged for leasing private residential property in which the municipality has no property interest.
Just cause · Detail
Either party may end a month-to-month tenancy with at least 30 days' written notice (7 days week-to-week) without stating a reason; fixed terms expire.
Return deadline · Detail
Refund with itemized deductions no later than 45 days after termination of the tenancy, delivery of possession AND demand by the tenant; bad-faith retention exposes landlord to $200 plus actual damages.
Nonpayment notice · Detail
After default in rent, 3 days' written notice requiring payment or possession must be served before removal proceedings; email/text service allowed if tenant agreed in writing.
