Jurisdiction key details

Rent cap · Detail

No state limit on rent increases; counties and municipalities are barred from regulating the amount of rent on privately owned residential property (may regulate property they own or have agreements on).

Deposit cap · Detail

No landlord may demand or receive a security deposit exceeding two months' rent; added by the Safe at Home Act (Ga. L. 2024, HB 404), applies to residential leases entered or renewed on/after 2024-07-01.

Rent increase notice · Detail

No rent-increase notice statute. DCA Landlord-Tenant Handbook reads § 44-7-7 as requiring 60 days' notice for a landlord to change the terms (incl. rent) of a tenancy at will; fixed-term rent is governed by the lease.

City rules · Detail

No county or municipality may enact, maintain or enforce any ordinance regulating the amount of rent for privately owned single-family or multi-unit residential property. No local just-cause ordinances known.

Just cause · Detail

A tenancy at will (incl. expired lease continued month-to-month) may be ended by the landlord on 60 days' notice (tenant 30 days) without stating a ground.

Return deadline · Detail

Refund, or written itemized statement of retained amounts plus balance, within 30 days after the landlord obtains possession of the premises (per § 44-7-33(b)); mailing to last known address suffices. Small-owner escrow/inspection exemption in § 44-7-36.

Nonpayment notice · Detail

Before filing a dispossessory for nonpayment, landlord must give written notice to vacate or pay all past-due rent, late fees, utilities and other charges within three business days (Safe at Home Act, eff. 2024-07-01).
