Jurisdiction key details

Rent cap · Detail

No increase above 3% effective on/after 2025-02-01 (higher notices deemed 3%); once per 12 months, none in the first 12 months. Officer may approve more for capital renovations, up to 9% (Reg 82-218 s.11.12). Reviewed yearly; 3% kept for 2027.

Deposit cap · Detail

Security deposit may not exceed one month's rent (one week's rent for week-to-week tenancies) and must be remitted to the Residential Tenancies Tribunal within 15 days; no other deposits or fees allowed (s.8(4)).

Rent increase notice · Detail

Written notice of increase, as a separate document, at least six months before it takes effect (period set by NB Reg 82-218 s.11.1) for fixed-term, yearly, monthly and weekly tenancies; tenant may ask an officer to review within 60 days.

City rules · Detail

Rent, deposits and termination are governed exclusively by the provincial Residential Tenancies Act administered by the Residential Tenancies Tribunal; municipalities have no rent-setting or tenancy powers.

Just cause · Detail

Periodic tenancies: landlord may serve a termination notice only for own/family occupation (≥3 months), change of use (≥3 months), an ended employment-tied tenancy, or officer-approved renovation; reason must be stated. Fixed terms end at expiry.

Return deadline · Detail

Deposit is held by the Tribunal: landlord must file any claim within 7 days after termination (7 days after month-end if ended by notice to vacate/quit); otherwise the officer returns it within 7 days of the tenant's written request.

Nonpayment notice · Detail

Notice to vacate for unpaid rent must give at least 15 days; paying all rent due within 7 days of service cancels the notice, except where a prior notice to vacate was served and the landlord states payment will not cancel it (s.19(6)).

New Brunswick Rent Increase Cap: 3% Limit on Annual Increases, Extended Through 2027

A New Brunswick landlord who tried to deliver a 6% rent increase notice after February 1, 2025 found that notice automatically reduced: the province's rent cap doesn't void an over-the-limit notice, it deems it to be 3% instead. That cap, originally brought in response to years of sharp rent growth, has since been extended through the 2027 calendar year.
