key details
Rent cap · Detail
No statewide limit on rent increases; H.3346 (2025-26) would cap increases at CPI + 7% but remains in House committee. Local rent regulation is barred by statute.
Deposit cap · Detail
§ 27-40-410 governs return and itemization of deposits but sets no maximum amount.
Rent increase notice · Detail
The Residential Landlord and Tenant Act is silent on rent-increase notice; an increase in a month-to-month tenancy is a change of terms subject to the 30-day termination notice (7 days week-to-week).
City rules · Detail
No county or municipal corporation may enact, maintain or enforce any ordinance regulating in any way the rent charged for privately owned residential or commercial rental property (except property it owns or voluntary agreements).
Just cause · Detail
Either party may end a month-to-month tenancy with at least 30 days' written notice (7 days week-to-week) without stating a reason; fixed terms expire.
Return deadline · Detail
Refund with itemized deductions within 30 days after termination of the tenancy and delivery of possession and demand by the tenant; if no forwarding address, mailing to last known address discharges the duty.
Nonpayment notice · Detail
Landlord may terminate if rent is unpaid 5 days after due, after written notice; no separate notice is needed if the lease conspicuously contains the statutory 5-day warning language (survives renewal to month-to-month).
