Jurisdiction key details

Rent cap · Detail

No statewide limit in the Residential Landlord and Tenant Act; municipalities are barred from regulating rent for private residential property.

Deposit cap · Detail

§115 requires escrow of deposits but sets no maximum amount.

Rent increase notice · Detail

No rent-increase notice provision; in practice a landlord changes month-to-month rent via the 30-day termination/renewal mechanism in §111. Fixed-term rent is set by the lease.

City rules · Detail

No municipal governing body may enact or enforce an ordinance regulating the amount of rent for privately owned residential or commercial rental property (exceptions for municipal-owned, subsidized and CDBG-assisted property).

Just cause · Detail

No just-cause requirement; month-to-month tenancies end on 30 days' written notice by either party (7 days if shorter period); fixed terms expire without notice.

Return deadline · Detail

Balance (with itemized statement) within 45 days after termination of tenancy, delivery of possession and the tenant's written demand; if no demand within 6 months the deposit reverts to the landlord.

Nonpayment notice · Detail

Landlord may terminate for nonpayment if tenant fails to pay within 5 days after written demand; demand doubles as demand for possession.
