Jurisdiction key details

Rent cap · Detail

No state law sets or limits rents. Increases must not be 'unconscionable' (court-reviewed under the Anti-Eviction Act) and must comply with any municipal rent control/rent-leveling ordinance.

Deposit cap · Detail

Deposit may not exceed one and one-half times one month's rent; annual increases to the deposit capped at 10%. Owner-occupied 2–3 family dwellings are exempt unless the tenant opts in by written request.

Rent increase notice · Detail

Rent cannot change mid-lease; landlord serves a notice to quit ending the tenancy and offering a new lease at the higher rent at least one month before it takes effect (Anti-Eviction Act). Increase must not be unconscionable or breach rent control.

City rules · Detail

Municipalities may adopt rent control/rent-leveling ordinances (upheld in Inganamort and Helmsley v. Fort Lee); roughly 100 do, e.g. Newark, Jersey City, Hoboken, Elizabeth, Paterson. New multiple dwellings exempt for 30 years (N.J.S.A. 2A:42-84.5).

Just cause · Detail

Anti-Eviction Act: residential tenants may be evicted only for the enumerated good causes; lease expiry alone is not a cause. Owner-occupied two- and three-family dwellings (and hotels/transient) are excluded and fall under N.J.S.A. 2A:18-53.

Return deadline · Detail

Refund with interest less itemized deductions within 30 days after termination (personal delivery or registered/certified mail); 5 business days if displaced by fire/flood/condemnation; 15 business days for domestic-violence terminations.

Nonpayment notice · Detail

No notice to quit is required before filing for nonpayment (2A:18-61.2); tenant can stop eviction by paying in full by end of the court day. Seniors/disability-benefit recipients get a 5-business-day grace period (2A:42-6.1).

New Jersey FAIR Act 2027: Landlords Can't Use Algorithmic Devices or Coordinators to Set Rents

A New Jersey landlord paying a software coordinator that pools competitors' nonpublic rent data to recommend prices is looking at a direct antitrust violation starting July 1, 2027. The Forbidding the Algorithmic Inflation of Rent Act doesn't just discourage this practice, it folds it straight into the state's existing antitrust law, and the definition of what counts as a prohibited "coordinator" is broader than a single pricing app.

Jersey City RUBS Utility Law 2026: Utility Fees Now Count as Rent Under the Rent Control Code

A Jersey City landlord using a ratio utility billing system to pass water, sewer, or trash costs to tenants of a rent-controlled building can no longer treat those charges as something separate from rent control. Adopted by the Municipal Council on May 20, 2026 and approved by the mayor the next day, Ordinance 26-028 writes utility fees directly into the legal definition of rent under Chapter 260, closing a path landlords had used to collect more than the rent cap otherwise allows.

New Jersey Rental Application Fee Cap 2026: Landlords Can't Charge More Than $50 Per Applicant

A New Jersey landlord who has been bundling a credit check, a background check, and a flat "processing fee" into one application charge needs to add those numbers up. Since May 1, 2026, the combined total for all of it cannot exceed $50 per applicant, and the cap climbs every January with inflation rather than staying fixed.

New Jersey Income Screening Law 2026: Minimum-Income Tests Must Use Only the Tenant's Share of the Rent

A New Jersey landlord screening a voucher holder who only needs to verify the applicant can cover their own portion of the rent, not the full market rate, has a new legal reason to drop that old habit. Since January 12, 2026, a minimum-income requirement that isn't based exclusively on the tenant's actual share of the rent is a violation of the state's Law Against Discrimination.

New Jersey Lead-in-Water Disclosure 2026: Pre-1986 Buildings Require Disclosure Before Lease Signing

A New Jersey landlord renting out a building put up before 1986 is about to pick up a new paperwork step before any lease or renewal goes out. Starting November 15, 2026, that landlord has to hand over a specific lead-in-drinking-water disclosure, built around whether the property's service line is made of lead, before the tenant signs.

Hoboken Algorithmic Rent-Setting Ban 2025: What "Price Fixing Using Algorithmic Pricing" Prohibits

A Hoboken landlord feeding nonpublic rent, occupancy, or lease-term data from other buildings into a pricing tool to decide what to charge has been operating outside city law since the summer of 2025. Ordinance B-781, adopted unanimously by the City Council on July 9, 2025, specifically bans that kind of data-sharing pricing software, more than a year before New Jersey passed a similar ban statewide.
