Jurisdiction key details

Rent cap · Detail

No statute limits the amount of a rent increase (NH Judicial Branch Law Library guidance); only 30 days' written notice is required.

Deposit cap · Detail

Deposit may not exceed one month's rent or $100, whichever is greater. Ch. 540-A deposit rules exempt a landlord renting one single-family home and no other rental property, or an owner-occupied building of 5 units or fewer (unless tenant is 60+).

Rent increase notice · Detail

Landlord must give written notice of the amount and effective date at least 30 days before a rent increase; a tenant's refusal to accept a properly noticed increase is 'good cause' for eviction.

City rules · Detail

No express state preemption statute located, but NH municipalities have only legislatively granted powers and no enabling statute for rent control or local just cause exists; no municipal ordinance known.

Just cause · Detail

'Restricted property' evictions need RSA 540:2 II grounds: nonpayment, damage, lease breach, health/safety, 'other good cause' (incl. business/economic) and, since 2025, non-renewal at end of a 12+ month lease on 60 days' notice. Nonrestricted: none.

Return deadline · Detail

Deposit plus accrued interest, or balance with itemized list of damages, must be returned within 30 days from termination of the tenancy. Refund model.

Nonpayment notice · Detail

Eviction notice for nonpayment (RSA 540:2 II(a)) must give at least 7 days; 30 days for most other grounds. Tenant may defeat eviction by paying arrears plus $15 liquidated damages before the writ issues (RSA 540:9), up to 3 times in 12 months.

New Hampshire Eviction Timeline Law 2026: New Deadlines for Appearing, Answering, and Hearings

A New Hampshire landlord who has watched a tenant sit on a writ of possession for up to 3 months after losing in court is getting a much tighter clock. Starting October 8, 2026, eviction cases follow fixed answer and hearing deadlines, and the maximum stay before a writ can be enforced drops to 60 days by default, though a tenant can still ask for more time under a narrower test than before.

New Hampshire Lease Non-Renewal Law 2026: No-Cause Non-Renewal for Restricted Properties on 60 Days' Notice

A New Hampshire landlord who has reached the end of a tenant's 12-month lease and simply wants a fresh start, without proving a violation in court, gets a new legal path to do that starting July 1, 2026. House Bill 60 adds lease expiration itself as a ground for eviction on restricted property, but only with 60 days' advance written notice, and it doesn't apply to every rental in the state the same way.
