Jurisdiction key details

Rent cap · Detail

No statewide cap on rent or rent increases in the Uniform Residential Landlord and Tenant Act; since 2025 (LB 266) local governments are also barred from imposing rent controls.

Deposit cap · Detail

Security may not exceed one month's periodic rent, plus a pet deposit of up to one-fourth of one month's rent; the cap does not apply to housing agencies under the Nebraska Housing Agency Act.

Rent increase notice · Detail

The Act sets no rent-increase notice period; a landlord changes month-to-month rent by terminating/offering new terms, so the practical floor is the 30-day periodic-termination notice in §76-1437.

City rules · Detail

A local government shall not enact or enforce any ordinance imposing rent controls on private property; exceptions for affordable-housing programs and voluntary owner agreements. Enacted by LB 266 (Laws 2025). No city had rent control before.

Just cause · Detail

Either party may terminate a month-to-month tenancy by written notice at least 30 days before the periodic rental date (7 days week-to-week) without stating a reason.

Return deadline · Detail

Balance and written itemization must be delivered or mailed to the tenant within 14 days after the date of termination of the tenancy (to last known address if no instructions given). Amended LB 433 (2019), LB 532 (2021).

Nonpayment notice · Detail

If rent is unpaid when due and the tenant fails to pay within 7 calendar days after written notice of nonpayment, the landlord may terminate the rental agreement (raised from 3 to 7 days by LB 320, 2021).

Nebraska Rent Control Ban 2025: Cities and Counties Can't Enact or Enforce Rent Controls

A Nebraska landlord searching for which city passed a rent control ordinance that this new state law overrides won't find one. Since September 3, 2025, no Nebraska city or county can enact or enforce rent control on private property, but this ban arrived as a preemptive move, not a response to an existing local ordinance, and it carries two exceptions worth knowing before assuming every rent-related local rule is now off the table.
