Jurisdiction key details

Rent cap · Detail

No statewide cap. Cities and counties (including charter governments) may not enact ordinances regulating the amount of rent for privately owned residential or commercial property.

Deposit cap · Detail

Landlord may not demand or receive a security deposit exceeding two months' rent. 'Security deposit' excludes money denominated as a pet deposit, so pet deposits sit outside the cap.

Rent increase notice · Detail

No rent-increase notice statute; for month-to-month tenancies a change of terms is effectively bounded by the one-month termination notice in §441.060(4). Fixed-term rent changes only per the lease.

City rules · Detail

§441.043 bars local rent regulation of private property (except locally owned property, voluntary subsidy agreements and CDBG-funded units) and also bars local deposit caps and screening restrictions; no local just-cause ordinances known.

Just cause · Detail

Month-to-month tenancy may be ended by either party with written notice of at least one month, effective on a periodic rent-paying date, without stating a reason. Fixed terms expire by their terms.

Return deadline · Detail

Within 30 days after termination of the tenancy, landlord must return the full deposit or furnish a written itemized list of damages withheld with any balance. Refund model.

Nonpayment notice · Detail

Rent-and-possession action requires that rent be due and payment demanded by the landlord and not made; no statutory number of days between demand and filing. Lease may add cure terms.
