Jurisdiction key details

Rent cap · Detail

No statewide limit on rent or rent increases; IC 32-31-1-20(b) bars local units from regulating rental rates of privately owned property unless authorized by the General Assembly.

Deposit cap · Detail

IC 32-31-3 (Security Deposits) regulates return and use of deposits but sets no maximum amount.

Rent increase notice · Detail

No statute sets a minimum notice for rent increases; in practice a landlord changes rent on a month-to-month tenancy by the one-month notice used to end/alter a tenancy at will (IC 32-31-1-1); fixed-term rent is set by the lease.

City rules · Detail

Local units may not regulate rental rates, security deposits, lease terms, screening, fees or other aspects of the landlord-tenant relationship for private property unless the General Assembly authorizes it; such ordinances are void.

Just cause · Detail

No statutory good-cause requirement. A month-to-month/at-will tenancy may be ended by one month's written notice (IC 32-31-1-1); no notice is needed when a fixed term expires (IC 32-31-1-8(1)-(2)).

Return deadline · Detail

Refund or itemized written notice of deductions with balance within 45 days after termination of the rental agreement and delivery of possession; landlord not liable until tenant gives a written mailing address. Failure forfeits deductions.

Nonpayment notice · Detail

Landlord may terminate for nonpayment with not less than 10 days' notice, unless the lease provides otherwise or the tenant pays in full before the period ends; leases commonly waive the notice (IC 32-31-1-8(5)).
