Jurisdiction key details

Rent cap · Detail

No statewide cap on rent or rent increases. Since 2023 (ch. 2023-17), local governments may not adopt or maintain any measure imposing controls on rents; residential-tenancy regulation is preempted to the state.

Deposit cap · Detail

Part II of ch. 83 regulates how deposits are held and returned but sets no maximum amount; local deposit caps are preempted by §83.425.

Rent increase notice · Detail

No rent-increase notice statute; in practice an increase in a month-to-month tenancy is bounded by the 30-day termination notice in §83.57(3). Since 2023, §83.425 preempts local ordinances (e.g., former Miami-Dade/Broward 60-day rules).

City rules · Detail

§166.043(2) (municipalities) bars any local measure imposing controls on rents (inclusionary-zoning land-use tools excepted); §83.425 (2023) preempts regulation of residential tenancies, including notice, screening, deposit and fee rules, to the state.

Just cause · Detail

A tenancy without a specific term may be ended by either party on notice (month-to-month: 30 days; week-to-week: 7; quarter-to-quarter: 30; year-to-year: 60) without a stated reason. Retaliation (§83.64) and fair-housing limits still apply.

Return deadline · Detail

Refund within 15 days after tenant vacates/termination if no claim; otherwise written claim notice by certified mail within 30 days (tenant has 15 days to object); landlord who fails to give notice forfeits the claim. Refund model, not refund-or-claim.

Nonpayment notice · Detail

Written demand to pay or vacate giving 3 days, excluding Saturdays, Sundays and legal holidays, before the landlord may terminate and file; tenant may cure by paying within the period.

When a Tenant Breaks HOA or Condo Rules in Tampa, Is the Landlord Responsible?

A tenant plays music too loud after a pool party, parks a second car in a visitor spot overnight, or lets a dog off-leash past the clubhouse, and the violation letter that shows up a week later has the tenant's name on it, not the owner's. Florida allows that. What it doesn't do is treat a Tampa condo and a Tampa HOA the same way once that letter turns into an actual fine, and the gap between the two has only widened since a 2024 change to the HOA statute.

Renting in an HOA or Condo in Tampa: What Move-In Rules Can the Association Require?

A tenant's car gets towed from a Tampa HOA street the first week of the lease, and the landlord's first question isn't about the tow fee. It's whether the association even had the authority to order that tow in the first place, and the answer turns on a fact most people never check: whether that particular street is actually private property the association controls, or a public road the county or city owns underneath the HOA's landscaping and signage.

Renting in an HOA or Condo in Miami: What Move-In Rules Can the Association Require?

A landlord clears tenant screening, signs the lease, and assumes move-in is just a matter of scheduling the elevator. Then the association's $100 lease-approval fee shows up as a separate line item from the tenant's own security deposit, a service animal request lands on the desk the same week, and a recent shift in federal enforcement priorities has some boards acting like the rules changed when, for a Florida resident, they mostly haven't. Move-in in a Miami condo or HOA runs on several rulebooks at once, and knowing which one actually governs each piece keeps a routine move-in from becoming a dispute.

When a Tenant Breaks HOA or Condo Rules in Miami, Is the Landlord Responsible?

A tenant racks up three noise complaints in a Miami condo, and the fine notice that follows names both the owner and the tenant directly. That's not a clerical oversight. Florida is one of the few states where an association can pursue a tenant by name, in addition to the owner, something that isn't true in most of the jurisdictions this series has covered so far. It changes what a landlord actually needs in a lease, and what a tenant should expect if their own conduct triggers the notice.

Can a Tampa HOA or Condo Association Approve or Reject Your Tenant?

A landlord submits a tenant's application to the HOA, hears nothing for three weeks, and starts wondering whether the silence itself means something. For most applicants in Tampa, Florida law sets no deadline at all for that response, so the silence is just the association being slow. For one specific category of applicant, it's the opposite: the law sets a hard 7-day clock, and missing it can mean the board loses its say entirely.

Florida Eviction Notice by Email 2025: Chapter 83 Notices Can Now Be Delivered Electronically

A landlord who emailed a 3-day pay-or-quit notice to a Florida tenant used to be taking a real risk that a court wouldn't count it as proper delivery at all. Since July 1, 2025, email is a legitimate delivery method for statutory Chapter 83 notices, but only once both sides have signed a specific addendum agreeing to it, and the timing rules that follow are less forgiving than they might first appear.

Florida Fraudulent Entry Law 2026: Using False Documents or Identity to Rent Is a New Crime and Eviction Ground

A tenant who talks their way into a Florida rental with a forged pay stub or someone else's identity used to leave a landlord working through the same notice-and-cure process as any other lease violation. Starting October 1, 2026, that changes. Chapter 2026-143 makes fraudulent entry into a residential dwelling a third-degree felony and strips away the tenant's chance to fix it once a landlord catches on.
