key details
Rent cap · Detail
Allowable annual rent increase set by the Director/IRAC (2.3% for 2025, 2% for 2026); control attaches to the unit, including between tenants. Increases above the guideline require IRAC approval on application.
Deposit cap · Detail
Landlord may not require or accept a security deposit greater than one week's rent for a week-to-week tenancy or one month's rent in any other case.
Rent increase notice · Detail
At least three months' written notice before the effective date for month-to-month and fixed-term tenancies; only one increase per 12 months and not above the allowable annual increase unless approved.
City rules · Detail
Rent regulation is provincial: the Act applies to all residential tenancies in PEI and municipalities have no rent-setting or tenancy-termination power.
Just cause · Detail
A tenancy may be ended only in accordance with the Act; landlord notices must rest on listed grounds (non-payment, cause, landlord's/purchaser's use, demolition/conversion/major renovation, end of employment, etc.).
Return deadline · Detail
Within 15 days after the tenancy ends (or is assigned) the landlord must either pay the deposit with interest or apply to the Director to claim against it; failure forfeits the claim and can lead to a double-deposit order.
Nonpayment notice · Detail
Eviction notice (Form 4) may be served the day after rent is due; it takes effect 20 days after service. Paying all arrears within 10 days voids the notice; tenant may otherwise dispute within 10 days.
