Rent cap · Detail

Interim Residential Rental Increase Cap Act: max 5% per year for existing tenants 1 Jan 2026–31 Dec 2027 (Act expires after 31 Dec 2027). Applies to new fixed-term leases with the same tenant; excludes public housing and land-lease communities.

Rent increase notice · Detail

Written notice of at least 4 months for year-to-year and month-to-month tenancies (8 weeks week-to-week); no increase in first 12 months and not more than once in any 12-month period; capped at 5% through 2027.

City rules · Detail

Rent rules are set provincially under the Residential Tenancies Act and the Interim Cap Act; Nova Scotia municipalities have no rent-setting or tenancy-termination power.

Just cause · Detail

Landlord may only give notice to quit on statutory grounds (s.10(3A)): nonpayment, breach, uninhabitability, landlord/family own-use and other listed cases. Fixed-term leases end on the stated date (s.10A) unless renewed.

Return deadline · Detail

Within 10 days of termination of the lease the landlord must return the deposit with interest, or (with tenant's written consent or by application to the Director) file a claim to retain it. Trigger is lease termination.

Nonpayment notice · Detail

If rent is unpaid 3 days after due, landlord may give notice to quit effective no earlier than the 10th day after it is given; tenant voids it by paying arrears within 10 days or may apply to the Director to dispute within 10 days.

Nova Scotia Rent Cap 2026-2027: 5% Annual Limit on Rent Increases Within a Tenancy, Extended to December 2027

A Nova Scotia landlord raising rent for an existing tenant in 2026 still works within the same 5% ceiling that applied before, but that ceiling was never meant to be permanent. Originally set to expire at the end of 2025, the province extended it through December 31, 2027, locking in the same 5% figure for 2 more years before the cap Act itself sunsets.

Nova Scotia Domestic Violence Lease Rules: Tenants Leaving Early Can Request a New Lease for the Same Unit

A Nova Scotia tenant terminating a lease early to escape domestic violence previously faced ending their housing entirely, since the law addressed only the termination itself, not what came after. A newer amendment adds a specific right: that same tenant can simultaneously request a new lease on the same unit, on the same terms, and a landlord who wants to refuse has a strict 10-day window to apply for permission to deny it.
