Before ending a Calgary tenancy

Ending a tenancy in Alberta turns first on the term. A fixed term ends on its date with no notice from anyone; a periodic tenancy can be ended by the landlord only for a prescribed reason on three tenancy months' notice; a substantial breach gets 14 clear days; assault or serious damage gets 24 hours. This navigator identifies the route and what you'd need to establish first. It does not generate a notice, and only the RTDRS or a court ends possession.

Before you decide

  • Do not assume Ontario-style automatic continuation: an Alberta fixed term ends on its date. Do not assume the reverse either: a periodic tenancy needs a prescribed reason.
  • A notice for the wrong amount, the wrong period or without a stated reason is a defence; the clock restarts.
  • Only an RTDRS or Court of King's Bench order, enforced by a civil enforcement agency, removes a tenant. Lockouts and utility shut-offs are unlawful.

What is the reason?
