1. How the 2.6% is calculated
The Residential Tenancies Act, in force since September 1, 2025, ties the rent index to a two-year average of the all-items Consumer Price Index for Whitehorse. For 2026, the average of 2.0% for 2024 and 3.2% for 2025 gives 2.6%.

2. Which increases the 2.6% covers
The index covers rent increases effective from May 15, 2026 to May 14, 2027. A landlord whose increase takes effect on May 14, 2026 is on the earlier figure. One whose increase takes effect on May 15 is on 2.6%.

The government states that landlords can increase rent up to 2.6% but can choose a lesser increase or hold the rent where it is.

3. A worked example
On a rent of $1,500, 2.6% is $39, giving $1,539. On $1,800, the maximum is $46.80, giving $1,846.80.
A landlord who rounds the figure up to the next dollar has gone over the index. Calculate to the cent and keep the working with the notice.
4. Notice and timing
Landlords must give a Notice of rent increase at least three months before the increase takes effect, on the approved form. For an increase effective May 15, that means notice served by February 15 at the latest, before adding any allowance for the delivery method.

A new tenancy cannot see an increase for the first 12 months, and after that rent can rise once a year.

Government guidance on ending tenancies lists hand delivery and consented email as received the same day and registered mail as received five days after mailing. That guidance is written for termination notices, so the sources reviewed do not confirm that it governs rent increase notices. A landlord serving a rent increase by mail should allow for the extra days anyway.

5. What happens after 2026
The government's release calls 2026 the last year the rent index applies in its current form, pending regulatory changes. It says the intention is to phase out the cap by amending the Residential Tenancies Regulations, and that the current mechanism stays in effect until changed by order in council.

The sources reviewed do not confirm that an order in council has been made. A landlord planning increases beyond May 14, 2027 should check the Yukon government's rent increases page before relying on any figure.
6. Units outside the index
The government's rent increases page exempts housing agencies, including the Yukon Housing Corporation, Kwanlin Dün First Nation and Grey Mountain Housing Society, where rent is tied to income. Older government guidance on the rent index also listed units with shared bathrooms or kitchens and short vacation rentals as outside the cap. That older page predates the new Act, so check whether those exemptions carry over.

7. If a landlord needs more than 2.6%
A landlord can apply for an above-index increase for extraordinary expenses, up to 3% above the index for a maximum of three years. The application goes through the Residential Tenancies Office.

A landlord should not collect the higher figure before approval.
8. What property managers should do now
Set the notice date for each unit by counting back three months from the intended effective date, and add a margin for delivery. Record each tenant's last increase so the once-a-year rule is checked before a notice goes out.
Keep a copy of the notice, proof of service and the calculation. If the cap is replaced after May 2027, those records show what was charged under it.
